In a recent opposition filed with the USPTO, Kylie Minogue opposed a trade mark application for "KYLIE" filed by Kylie Jenner. Ms Minogue claimed that her earlier rights and use of KYLIE would likely give rise to confusion, mistake or deception and also that any use of KYLIE by Ms Jenner would dilute Ms Minogue's brand by either blurring or tarnishment.
For those who do not frequent the world of "Keeping up with the Kardashians", Kylie Jenner is the younger half-sister of Kim, Kourtney and Khloe and daughter of Caitlin Jenner, previously known as Bruce Jenner. Ms Jenner has a number of US trade mark registrations for KYLIE JENNER and KENDALL & KYLIE (referring to her older sister Kendall). However, it is her application for KYLIE (simpliciter) for "advertising services, namely promoting the brands, goods and services of others; endorsement services, namely, promoting the goods and services of others" that caught Ms Minogue's attention. Ms Minogue is the owner of a number of trade mark registrations and applications in the US for KYLIE and KYLIE MINOGUE.
Under the US concept of trade mark "dilution", by establishing that the mark is a famous mark, the owner of the mark can prevent anyone else using that mark without having to establish any likelihood of confusion. As Ms Minogue does not have any US trade mark registrations for goods and services that are similar or related to those applied for by Ms Jenner, it may be difficult to show that there was a likelihood of confusion that meant Ms Jenner's application should be refused. In the US, it may also be difficult to establish that her mark is sufficiently famous to make out an argument for dilution.
How might this play out in Australia?
Ms Jenner has also filed a trade mark application for KYLIE in Australia and the application is currently under examination.
If Ms Jenner's application is accepted in Australia, it would be expected that it would be opposed. Any opposition battle for KYLIE in Australia would be more heavily weighed in Ms Minogue's favour than in the United States, in light of both existing trade marks, and reputation and use. Having had a music career spanning 30 years, along with her time as Charlene on Neighbours and more recently as a judge on The Voice Australia, there would hardly be a person in Australia that was not aware of "our Kylie".
Therefore, even though a likelihood of confusion relating to reputation would have to be shown in Australia, it would be assumed that Ms Minogue's reputation in KYLIE would be sufficient to successfully oppose Ms Jenner's application. It is also expected that she would be successful on the ground of first use, as Ms Minogue's use of KYLIE dates back at least to her debut album released in 1988 entitled "Kylie" and includes her ownership of the website www.kylie.com since 1996, which predates Ms Jenner's birth.
Ms Minogue also has a broader range of trade mark protection in Australia, including an earlier trade mark for "education and entertainment" services. In contrast, her US application for the same services post-dates Ms Jenner's application by a month, which would appear to be how Ms Jenner's application was able to proceed to acceptance.
Ms Jenner has until 2 April 2016 to respond to Ms Minogue's opposition in the US so we will be waiting to see the counter-shot in this battle of the Kylies.

Last month I spent a week in Manchester—England’s second city. A Mancunian friend of mine describes the city as one that “embraces modernism but still clings to its industrial heritage.” A fitting description for a city full of juxtaposition. Newly constructed glass and steel buildings sit next to classic Victorian architecture and former cotton mills. The beautiful, blossoming, bustling city was my home for a week, and it was also the home of Kylie Minogue’s KYLIEX2008 tour during a six-night residency at the Manchester Evening News Arena. With the Australian singer’s last three tours and now, including KYLIEX2008, Kylie has performed 23 dates at the Manchester Arena. The show, which supports her 10th studio album X, sold out the arena all six nights, had the crowds cheering from the rafters, and left fans screaming for more.
I was fortunate enough to see four of the six concerts in Manchester and I had the pleasure to meet with Nick Whitehouse, the show’s LD, and tour backstage. The concept for the show’s design, a giant “light box”, came from Kylie’s creative director, William Baker. The set comprises a rectangular, raked main stage and two band risers stage left and stage right of this. The main stage has three independently controlled lifts, lined up in a row stage left to right. Essentially, the stage is an enormous video screen, or, more precisely, lots of different video elements put together.
The deck for all three platforms is made up of thousands of Barco’s MiStrip modules and the stage is flanked upstage by layers of video curtains that are cleverly used as reveals and entrances throughout the show. Whitehouse’s lighting rig (including some X-shaped truss supporting the tour’s X manifesto) compliments the video-heavy show and his rig consists mostly of Vari-Lite VL3000 and VL3500 Spots, VL3500 Washes, and VL500 Washes. The rig is rounded out with equipment from SGM, Martin Atomic strobes, Lycian truss-mounted spots, Color Blasts, Showtech Sunstrips, Molefays, and other units. Touring with the show, Whitehouse acts as board operator, controlling his extensive rig with an Avolites Diamond 4 Vision console.
Standing onstage while the crew performed their video checks was a fantastic, yet, dizzying experience. During the song “Wow” the video floor flashes fervently in fluorescent blues, pinks, and neon greens. I chuckled to myself and wondered, “How do they perform complicated choreography on this raked TV screen that’s constantly pulsing under their feet?” I don’t know how they do it, but, even in heels, Kylie and the dancers perform without falter and shine throughout the 29-song set list.
Kylie Minogue has bombed in the US. The Australian pop princess hoped to score big on the American music charts with the release of her latest album X last week, but when the numbers were released today she only managed to sell a paltry 5500 copies.
The poor sales meant X debuted on America’s Billboard charts at a lowly 139.
The US market, unlike Australia, Europe and Asia where she has dominated, has again proved elusive.
Minogue, 39, appeared to do everything right to promote the album.
She performed two songs in front of almost 30 million US TV viewers on America’s Dancing with the Stars and in an interview on Ellen DeGeneres’ talkshow she dropped a bombshell when she revealed for the first time a doctor had initially misdiagnosed her breast cancer.
There were also appearances on NBC’s top-rating US morning TV news-entertainment program, Today, and a late night spot on the CBS talkshow hosted by comedian Craig Ferguson.
Some critics say Minogue and her handlers picked the wrong single to perform on the talkshows, the slower tempo All I See.
Minogue was well aware of how hard the US market was to crack with her style of pop music.
“It’s a notoriously difficult market,” Minogue said in her interview on Today.
“You have so many denominations with radio.
“To know where I fit within that market is sometimes difficult.”

Scientists have discovered the secret to the perfect pair of legs - an extra five per cent.
Research found that the average woman - at around 5ft 4in tall with an inside leg measurement of 29in - would need shapely 30.5in legs to reach perfection.

However, very long legs are not necessarily better because the study also showed that those with an extra 10 per cent were actually rated as less attractive.
The findings could explain the sex appeal of stars such as Kylie Minogue, the singer, who despite being only 5ft tall, has topped polls of the "best celebrity legs".
Although her legs are petite, they are proportionally long compared with her small frame. It could also explain why women often choose to wear high heels, giving the illusion of longer limbs.
Polish researchers at Wroclaw University asked 218 male and female volunteers to rate, in order of attractiveness, seven silhouettes of a man and woman.
advertisementAlthough the images were the same height, each had different leg lengths. The most attractive were judged to be those with legs that were five per cent longer than average.
The average British man, at 5ft 10in with an inside leg measurement of 31in, should have an inside leg measuring 32.5in.
Dr Boguslaw Pawlowski, who led the study, said that long legs signal health.
He said that short legs are linked with a higher risk of cardiovascular disease and type II diabetes and with higher levels of a body fat called triglyceride, which is linked to the clogging of the arteries, heart disease, strokes and insulin resistance in men.
Although the study, reported in New Scientist, was limited to Polish people, Dr Pawlowski suspects the results would apply across most Western cultures.

COLOGNE, Germany (Hollywood Reporter) - Robert de Niro and Aussie pop star Kylie Minogue will receive Germany's top show-biz honor, the Golden Camera, at this year's ceremony in Berlin, organizers announced Wednesday.
De Niro will receive a lifetime achievement award, while Minogue will be honored as best international music act.
Much like a local version of the Golden Globes, Germany's Golden Cameras award excellence in film, television and music. The Golden Camera gala is the top show-biz event on the German calendar.
Previous international Golden Camera winners include George Clooney, Nicolas Cage, Cate Blanchett, Steven Spielberg and Bruce Willis.
Now in their 43rd year, the Golden Camera awards are presented by German publishing giant Axel Springer and Horzu, the country's leading TV listings magazine.

The 39-year-old, who released her new album "X" this week, starts in Paris on May 6 and crosses Continental Europe, Scandinavia and Northern Ireland before winding up at London's O2 Arena on July 27.
"The eclectic mix of sounds on 'X' is affording me an opportunity to explore and develop a new live show that will be fresh, exhilarating and innovative," Minogue said on her Web site www.kylie.com.

KYLIE MINOGUE is a phenomenon. At just 5ft 1in, and petite as a Polly Pocket, the pert-bottomed popsicle enjoys a level of popular affection way beyond that routinely accorded to the most dazzling of superstars. Her success is global, crossing geographical and generational divides, and her likeability is legendary. Oh, the one woman who really could challenge Diana for the title of people's princess surely must be little Ms Minogue.
Next month, following record-breaking visitor numbers at previous stagings in London and Manchester, Kylie: the Exhibition arrives at Kelvingrove Art Gallery and Museum in Glasgow. Queues will stretch beyond the horizon as Pa, Ma and the Weans grasp this opportunity to inspect the baggy overalls Minogue wore 20 years ago as Charlene in Neighbours; to gasp at the extravagance of the spectacular headdresses made by master milliner Stephen Jones for her Showgirl tour; to ogle at those microscopic gold hotpants that so memorably graced her celebrated derrière in the video for 'Spinning Around'... Amid the gallery's Rembrandts and Van Goghs, alongside its medieval armour and Mackintosh treasures, this a celebration befitting a cultural icon. But does the 39-year-old singer really merit such an honour?
"You could say she's a little like a modern version of Vera Lynn, the forces' sweetheart," suggests Stephen Jones, who has helped create some of Kylie's most fantastical stage costumes.
"She's the girl who made it, the girl who can do no wrong. And her recent battle with cancer has only further endeared her to us. That word 'icon' is used so carelessly these days, but I think it truly applies to Kylie."
You can't imagine the Melbourne-born Kylie unleashing a diva tantrum. "Never," confirms Jones. "She's extremely professional, with an extraordinary wealth of experience as a performer. But she is not a prima donna, and not at all grand. I think she's still genuinely delighted by her success - perhaps a little surprised by it. Her status has given her confidence, but she has humility too. A slight vulnerability is most certainly part of her charm."
Even when she fell under the potentially dark influence of bad-boy rocker Michael Hutchence, she was never caught throwing television sets from hotel windows or diverting the Colombian cocaine harvest to her winnebago. Yet neither is she exactly boring - unlike most good girls, she has tangible sex appeal. And whenever she plays vamp or ultra-camp (and heaven knows her videos harness a lot of such role-play), her performance retains a knowing sense of irony. On stage, she radiates self-assurance, and she has made increasingly shrewd choices about her career in terms of what she should be doing - and with whom she should be working. She's a smart cookie, and even though she took most of 2005 off to fight cancer, she still managed to double her annual earnings - to £4.5 million.
Of course, some of the movies she has made during her 20-year career have been absolute stinkers. And there have certainly been periods (not least her dalliance with the indie music scene) when she has tried the patience of her mainstream fan base. But in her re-establishment as the first lady of disco, unlikely collaborations with Nick Cave or the Manic Street Preachers (not forgetting her relationship with Hutchence) have clearly served a purpose.
Her spectacular contribution to the closing ceremony at the Sydney Olympics is the most-watched performance of all time. And it's hard to think of a single performer whose fans represent quite such a broad church.
It helps that her likeability is matched (in part fuelled) by genuine talent. Whether or not you rate her irrepressibly and unapologetically lightweight music, you have to acknowledge Minogue as an accomplished performer.
According to Pete Waterman, architect of her earliest success as a recording artist: "She has a great voice, a terrific sense of humour, a fabulous personality, and she knows how to really sell a song."
She has always connected with the gay community, but middle-aged straight men fantasise about her too. And what they'd do, given half the chances of on-off boyfriend Olivier Martinez. Given her all-round perfection, her lack of a lasting relationship is something no one can fathom. GQ once gave her a special award for 'services to mankind', and Heat magazine readers have voted her the sexiest celebrity in the world. Women secretly long to be her and, rather like a real-life Barbie, she also connects with the under-tens for whom the highlight at Kelvingrove will surely be the roomful of feathers and sparkly nonsense from which they'll be encouraged to fabricate their very own costumes.
She knows how to make the fashion world work for her - in recent years trusting the sharp judgment of her stylist William Baker and nurturing cosy relationships with a coterie of leading designers including John Galliano, Karl Lagerfeld at Chanel, and Dolce and Gabbana.
The Italian design duo - whose contribution to the famous wardrobe is represented by a pair of hipster trousers with belt buckles from hip to ankle, and a silver mesh top Minogue wore for the MTV Europe Music Awards in 2002 - describe the singer as "an eclectic and fabulous personality on stage". But their friendship goes far beyond the professional. Following her cancer treatment, they whisked her off to their Italian seaside home to give her time to recuperate and escape the prying eye of the media.
Her style has certainly progressed, from the unsophisticated ingenue with a bubble perm in 'I Should Be So Lucky' to the postmodern sex kitten in a white-hooded jumpsuit singing 'Can't Get You Out of My Head'. Much of that transformation is down to Baker, whom Minogue met while he was studying theology at King's College London and working part-time at the Vivienne Westwood shop. It was he who tracked down those famous hotpants for 50p at Oxfam (they are now insured for £1 million), encouraging her to make the most of what is far and away her best asset. He was also responsible for taking the scissors to a beautiful, bejewelled Julien Macdonald dress for her performance with Justin Timberlake at the 2003 Brit awards.
"I spent many sleepless nights sewing crystals on to Kylie's outfits," recalls the designer. "There never seemed to be enough sparkle on these dainty clothes."
After calling on Macdonald for a last-minute show-stopping frock for the Brits, she was given a long, black, backless number with crystal detailing at the neck. By the time she appeared on stage, however, it had been transformed into a slashed-to-the-thigh mini. "That night my heart stopped," says Macdonald. "Kylie had cut the dress. She did look fantastic, though, and it made all the front pages, so all was forgiven."
These days, her off-stage looks tend to be elegant, dignified and rather closer to prim than pretty. There's a clear divide between the real Kylie Ann Minogue wearing, for instance, that classic white crocheted Chloé dress (which also features in the exhibition) and her fabulous persona in sparkling corsets and 3m-high feathered headdresses who can have a stadium audience eating out of her hand.
Unlike Madonna or Gwen Stefani, who have made a strong fashion sensibility a major part of their cults, Minogue has never been known to inspire a trend. However, on those relatively rare occasions when she has put her name to a fashion project (the Love Kylie lingerie line or this summer's swimwear range for H&M for example) the merchandise has sold like hot-cakes.
The Glasgow manifestation of Kylie: the Exhibition promises to prove equally compelling. Despite our salacious interest in the foibles and fallibility of celebrities, a lot of people are prepared to celebrate one star who doesn't spend more time in rehab than the recording studio. What's not to like about Minogue? Very nice, and not too naughty: oh, she's almost too good to be true. r

"Far be it from any of us to give a girl a hard time when she's faced down breast cancer with the same kind of kick-ass perkiness with which Buffy dispatched of vampires, only to emerge, still smiling, to find her relationship in tatters and her gallingly handsome boyfriend making short work of cosying up to someone else. On the contrary, we've got nothing but admiration for Kylie, which is why it's with some dismay that we're forced to wonder -- what's going on with her wardrobe?
Everyone knows that her relationship with her stylist William Baker borders on a marriage. But one has to question whether a man whose appreciation of women is of the strictly aesthetic, non-carnal kind is the best person to advise at a time when looking totally, devastatingly, look-what-you're-missing smokin' hot was never more imperative.
Sure, Baker was the guy who put Kylie in the now-iconic gold hot pants. That was nothing short of a moment of sartorial virtuosity at the time, providing, as the hot pants did, an exquisite balance of exposure and support of that backside. Displayed to such advantage, it could almost be argued that it was Kylie's derriere that buoyed a whole new, glittering phase of her career.
But if it is Baker who is setting the rather prim, frigid tone of her current off-duty wardrobe, then I reckon she might want to reconsider his control as executive creative director and grand artiste of the Kylie brand, or whatever his official title is.
Seen out recently in a billowy, purple, blue and aqua confection teamed with preppy little sandals, Kylie seemed to have lost her golden fashion touch. In her career, she puts her success down to being an all-rounder rather than a specialist, and the same has, in the past, applied to the way that she dresses. She's always been a jack-of-all-trades fashionista who pulled off red carpet glamour with the same impeccable competence with which she rocked her comfy casuals. Even when just strolling around town in jeans and jacket, there was always something kittenish about Kylie, a subtle touch of that trademark, unthreatening raunchiness that was always so quintessentially Kylie.
It was the advent of her Showgirl tour -- cancelled halfway through when she was diagnosed with cancer -- that we saw the apotheosis of the essence of Kylie. Consummate pop professional and unstoppable chart dominator, she managed to straddle the gap between starlet and legend without once losing composure. At the height of her powers, when not out in an official capacity sporting winsome Chloe numbers or camp glittery gowns, she was most often photographed stalking around in knee-high boots pulled over skin-tight jeans.
But recently the strident power-boots have given way to prissy little pumps and strappy sandals. She spent her recovery from cancer in Paris with French actor and former boyfriend Olivier Martinez, and since then there has been a distinctly Gallic tone to her mode of dressing. Which would all be fine and nice and appropriate for a woman now facing into her forties were it not for the fact that it doesn't really suit her.
Instead, Kylie looks like somebody who is smothering her sexuality in complicated tailoring, cute hats and kicky necklines.
Kylie's physical appeal has always been as a glossy pin-up rather than a classic Audrey Hepburn, waspish-type, and her attempts at doing the latter have left her looking decidedly mumsy.

Pete Waterman has announced that he will never work with Kylie Minogue again. Given that his next venture will be creating some dire racket out of the Sheilas' Wheels insurance ads, I'm sure Kylie is breathing a huge sigh of relief.
Waterman, a man renowned for his modesty, plays down his part in Kylie's success in an interview with Digital Spy, shyly revealing how he created her career from thin air and, when fickle fashion turned against her, stood rock-firm and waved the flag for Brave Kylie.
"Kylie was the antichrist for five years of her life, and you know what, I defended that for five years," Waterman frothed. "People around tend to forget what it was like back in 87, 88, 89. But I don't forget and Kylie doesn't forget. It was not fun."

Kylie Minogue has a "black girl butt" and she wants the world to know! While attending an event at the Cannes Film Festival, Mingoue made the declaration and compared herself to the likes of Beyonce and Jennifer Lopez.
She supposedly quipped:

I wouldn't believe a word of this for at least two reasons. 1.) Kylie's bottom is much tighter and firmer than those two American girls. Hers has the dimples above and the concavity on the sides. The other two are bubble butt, with a looming threat of thunder thighs. Kylie's rear is much better. I would reject the others.
2.) Unless she is speaking to an American audience, Kylie wouldn't say "butt." That's an Americanism. Kylie would say "bottom," "bum" or, less likely, "rear" since she has repeatedly been designated as the Rear of the Year in the British press.

It starred Jane Fonda as a 41st-century astronaut who performed an gravity-defying striptease and quickly became a cult classic marking the height of 1960s psychedelia.
Now, Barbarella, the kitsch 1968 sci-fi film in which Fonda played an inter-galactic sex kitten who sets out to find the evil Duran Duran in space, will be remade by the director Robert Rodriguez.
Speaking in Cannes, Rodriguez, who co-directed the 2005 box office hit Sin City and collaborated with Quentin Tarantino on the horror movie double-bill Grindhouse, said he was excited by the prospect of the remake. "The possibilities are limitless. I love this iconic character and all that she represents," he said.
The film's original producer, Dino De Laurentiis, will be in charge of the remake, which is due to be released by Universal next year. The actress playing the lead part has not yet been named. De Laurentiis, who was also involved in the 1980 sci-fi filmFlash Gordon, said in a statement: "Barbarella is the ultimate science-fiction adventure heroine - smart, strong and sexy. In our vision, the future is female, and I can't wait to introduce Barbarella to a new generation of moviegoers."
Neal Purvis and Robert Wade, who co-wrote the screenplay for the latest James Bond film, Casino Royale, will work on the script.
In spite of the cult status which transformed Fonda into a universal sex symbol, Barbarella was a box-office flop. It was directed by Roger Vadim, her husband at the time, and caused a sensation with the opening scene, in which Fonda undresses in zero gravity.
The singer Kylie Minogue recreated the sequence in the video for her 1994 single, "Put Yourself In My Place". The British pop group, Duran Duran, also named themselves after the evil character in the film. The pop star Prince also said he was inspired by the film. His song "Endorphin Machine" from The Gold Experience album relates to the sexual torture machine which Duran Duran uses on Barbarella.
Barbarella first appeared in a French graphic magazine written and illustrated by Jean-Claude Forest in 1962. De Laurentiis secured the rights to the cartoon creation from Jean-Claude's son, Julien.The deal will also see the first two Barbarella books reissued, along with the publication of material previously unreleased in English.
The film, which was regarded as sci-fi "erotica" at the time it was released, was acted in a kitch, tongue-in-cheek manner especially the frequent, albeit non-explicit sex scenes.
To today's viewers, the film's special effects can appear crude and unconvincing but they were ambitious by the standards of the day. The psychedelic "blob" patterns that form much of the special effects in the original are created using an oil wheel projector, a popular visual effects device used in many other films of the same era.
The film was simultaneously shot in French and English, with Fonda delivering her lines in both languages.
